Terms of Service

1. Eligibility & Account Registration

• Be at least 18 years of age.
• Have a valid Facebook and/or Instagram Business account in good standing with Meta.
• Provide accurate, current, and complete information during registration and onboarding.
• Maintain the security of your PostEngine credentials and OTP verification codes.
• Notify us immediately of any unauthorized use of your account.

2. User Responsibilities

• All content you create, schedule, and publish through PostEngine including AI-generated posters and captions.
• Ensuring published content complies with Meta's Community Standards, Instagram Guidelines, and Facebook Page Policies.
• Accuracy of business information, offers, and product/service details provided during onboarding.
• Ensuring you have authority to manage all connected Facebook Pages and Instagram Business accounts.
• Complying with all applicable Indian and international laws and regulations.

3. Acceptable Use Policy

You agree NOT to use PostEngine to:

• Publish spam, unsolicited commercial messages, or misleading content.
• Violate any third-party intellectual property, privacy, or publicity rights.
• Spread misinformation, hate speech, or harassing or discriminatory content.
• Publish illegal, obscene, defamatory, or sexually explicit content.
• Attempt unauthorized access to other accounts or PostEngine systems.
• Abuse the AI generation system to produce harmful, misleading, or offensive content.
• Circumvent rate limits, access controls, or security measures of PostEngine or Meta's API.

4. Meta API & Third-Party Services

• Your use is subject to Meta's Platform Terms .
• PostEngine uses OpenAI APIs for content generation. Your business data is passed to OpenAI subject to their usage policies.
• Features may be temporarily restricted if Meta, OpenAI, or Google impose new API limitations.
• Payments are processed via PhonePe. PostEngine is not liable for PhonePe outages or failures.
• If your Meta account is suspended, PostEngine's ability to publish on your behalf will be affected.

5. Service Availability & Platform Limitations

• PostEngine may experience downtime for maintenance, updates, or unexpected outages.
• AI poster generation typically completes within 5–30 minutes of plan creation. Delays may occur during peak usage.
• Scheduled posts may fail due to API errors, expired tokens, platform outages, or network issues. We retry up to 5 times.
• We are not responsible for missed deadlines or business losses caused by publishing delays or AI generation errors.
• Daily usage limits apply per plan tier. Exceeding limits may pause generation or scheduling until the next day.

6. Content Responsibility

PostEngine generates content using AI based on your business profile — however, you are fully responsible for reviewing and approving content before it is published. You retain ownership of all content published through PostEngine. PostEngine is not liable for AI-generated content that is inaccurate, misleading, or causes reputational harm. We recommend enabling the approval step rather than running in full autopilot mode for sensitive categories.

7. Subscriptions & Payments (INR)

• Plans: Pro ₹1,499/mo or ₹1,999 one-time · Advanced ₹1,999/mo or ₹2,999 one-time. Yearly billing available at a discount.
• All payments processed via PhonePe in Indian Rupees (INR).
• Subscriptions auto-renew. You authorize recurring charges until you cancel.
• Fees are non-refundable unless required by law. Pricing may change with 30 days advance notice.
• Free trial: 7 days on Basic plan (2 welcome posters, 1 social account). No card required.

8. Account Termination & Data Deletion

• By You: Cancel anytime in app settings. Access continues until end of billing period.
• By Us: We may terminate immediately for Terms violations, fraud, or legal requirements.
• Scheduled posts will not be published after account termination.
• To request full data deletion visit our Data Deletion page. Data removed within 30 days of verified request.

9. Disclaimer & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW, POSTENGINE'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Governing Law

These Terms are governed by the laws of India. Any disputes shall be resolved under the jurisdiction of Indian courts. By using PostEngine, you consent to this jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of PostEngine after the effective date constitutes acceptance of updated Terms.
